On 1 August 2023, a new Czech Act on Protection of Reporting Persons will come into force introducing institutional protection for reporting persons (whistleblowers) in line with European legislation.
The main novelty is the obligation of obliged entities:
- to implement an internal reporting system, which will usually enable employees- reporting persons to report in a secure manner the breaches of which they have become aware in connection with their work activities; and
- identify the so-called designated person who will handle the report in accordance with the law.
The obligation to implement an internal reporting system applies only to entities with more than 50 employees, public contracting authorities (except for municipalities with a population of up to 10,000) and other selected organisations in regulated market areas and state organisations.
At the same time, the Act on Protection of Reporting Persons prohibits the application of so-called retaliatory measures by organisations against reporting persons and other protected persons.
